Terms for Test-Takers.

We are Ambition Profile AB (“We”, “Company”, “Us”, “Our”). We are currently conducting a research study to develop a personality test for the purposes of predicting job performance and other relevant workplace outcomes such as employee stress. For purposes of this study, you will answer a Survey, also known as “Pilot Test”, containing around 160 questions about your overall behavior, including some questions related to you and your workplace. The Survey also contains around 10 questions regarding your demographic information, we need this information to take into account the differences between groups of people and improve the fairness of the interpretation of the results. You also have to provide your contact information, including your name and email address. We need your contact information to be able to contact you in the event it becomes necessary.

You represent the following:

  • You will answer all questions in the Survey.
  • You are at least 18 years old.
  • All the content shown in the Survey, including but not limited to questions, phrases, graphic elements, and code, belongs to EQ Supplies.
  • You shall not copy, attempt to copy, or disseminate, any portion of the survey, Including without limitation the content.
  • You will not change or attempt to change any portion of the Survey.
  • You will not look for or access the code of any portion of the Survey that we have not expressly published.
  • By taking the Survey, you consent to the collection, use, sharing, and storage of the information you provide, as outlined in the Privacy Policy.

Disclaimer

Ambition Profile does not represent or warrant that your use of the surveys or platforms used to conduct the research study will be uninterrupted, without delays, error-free, or meet your expectations. We do not give any commitment relating to the performance or availability of the surveys and, to the extent we are able to do so under applicable law, it excludes any commitments that may be implied by law, including all guarantees and warranties, whether express, implied, or statutory, regarding the survey, content and related materials, including without limitation any warranty of fitness for a particular purpose, title, merchantability, or non-infringement of intellectual property rights, or any warranty arising from statute, course of dealing, course of performance, or usage of trade.

In the event of a claim arising out of the provision or use of the surveys or content, our responsibility to you will never be more than $5. In any event, we will not be responsible or liable to you for any loss or damage that is not reasonably foreseeable or for any punitive damages. The liabilities limited by the preceding sentence apply:

  1. To liability for negligence. 
  2. Regardless of the form of action, whether in contract, tort, strict product liability, or otherwise.
  3. Even if Company is advised in advance of the possibility of the damages in question and even if such damages were foreseeable.


Even if your remedies fail in their essential purpose. If applicable law limits the application of the provisions of this disclaimer, our liability will be limited to the maximum extent permissible.

Any part, provision, representation, or warranty of this Agreement, which is prohibited, or which is held to be void or unenforceable shall be ineffective to the extent of such prohibition or unenforceability without invalidating the remaining provisions hereof.

Disputes arising out of the process of responding to the Surveys or this agreement shall be settled by the Stockholm district court as an exclusive forum in the first instance. Copyright and Ownership

Ambition Profile, and its licensors, own all rights to the Service and its underlying technology. The Customer may not forward, mirror, copy or reuse any part of the Service’s code, text, or visual design elements. If you copy or disseminate or discuss any part of the content of the Survey, you will be liable for damages.

Severability

If any part or provision of these Terms for Test-Takers is held or determined by a court or authority of competent jurisdiction to be invalid or unenforceable in whole or in part, it will not impact any other provision or part of these Terms for Test-Takers, all of which will remain in full force and effect.

Notices

Any notice required or permitted to be given by Us to you shall be made by email in accordance with the details that you have submitted to Us. Any notice that you give to Us must be sent in writing to us to the following physical address:

Governing Laws and Jurisdiction

The laws of Sweden will apply to and govern any dispute related to these Terms for Test-Takers, your use of the Website, the Contents, or our Privacy Policy. You acknowledge and agree to the sole and exclusive jurisdiction and venue of the courts of Stockholm in the event of any dispute of any kind arising from or relating to these Terms of Use, your use of our Website, the Content, or our Privacy Policy.
