Ambition Profile AB (“Ambition Profile”, “We”, “Us”, “Our”)  has adopted the following Privacy Policy applicable to Personal Information that it may receive from you, whether you are a client, test administrator, test-taker, or collaborator. This Privacy Policy is related to the provision of services by Ambition Profile through the site “ambitionprofile.com”.

Definitions

For purposes of this Privacy Policy, the following definitions apply:

“Ambitionprofile”, also “Site” or “Website” is the website used to deliver the services offered by Ambition Profile.

“Client”, also “customer”, is a firm or organization for which we serve as a service provider.

“Collaborator” is a firm or organization that conducts collaborative research study projects with EQ Supplies.

“Test-takers” are people who take the tests we provide as a service or use for experimental purposes in collaboration projects. Test-takers may be employees of an organization, candidates for a job, or any other person that takes our tests.

“Test Administrator” is an individual designated and authorized by the Client to use this site to assign assessments to Test-takers and coordinate and manage the assessment process and/or receive assessment test results and reports.

“Personal Information” is all personally identifiable information that we collect, receive or process with respect to Test Administrators and Test-takers. Additional information about the Personal Information we collect or receive is found in the Collection and Use of Personal Information section of this Privacy Policy. 

“You” means a Test Administrator, Test-taker, or a Client authorized to use this site.

“User” is any person that uses the website for purposes of the provision of the service. Clients, Test administrators, and Test-Takers are considered Users.

Privacy Policy for Customers and Test Administrators

Ambition Profile AP (“Ambition Profiles”, “We”, “Us”, “Our”)  has adopted the following Privacy Policy applicable to Personal Information that it may receive from you, whether you are a client, test administrator, test-taker, or collaborator. This Privacy Policy is related to the provision of services by Ambition Profile through the site “ambitionprofile.com”.

Your Rights and Responsibilities

You agree that by visiting and/or providing, transmitting, or having another party you have authorized to transmit your Personal Information to us on our Site, you are accepting the practices described in this Privacy Policy and any updates made to this Privacy Policy. It is your responsibility to read this Privacy Policy and check for updates from time to time. By continuing to use our Site, products, or services after such updates have been made you are agreeing to be bound by any changes to this Privacy Policy.

You are never required to provide us with your Personal Information. If you do not agree to this Privacy Policy, please do not provide, transmit or allow an authorized third party to provide your Personal Information to us, however, in that instance, you may not be able to register, schedule, take a test or purchase products or services from us.

You agree that we may collect, receive, use, process, disclose, transfer and store your Personal Information as described herein. This Privacy Policy governs your use of any and all of our Sites and our services in general. We will use your Personal Information only for the purposes set forth herein. 

As the subject of the Personal Information collected, you have rights related to the Personal Information that we hold about you. At any time you have the right to:

-Ask us how to correct any inaccurate or incomplete information we have about you or request us to make the corrections.

Request us to delete your information from our records.

Upon receiving any request listed above, we may need to verify your request. We will respond to access requests within a reasonable amount of time in accordance with pertinent laws and requirements.

Under California law, Ambition Profile will only respond to verifiable requests that are made either: (a) by a California resident or (b) by a person registered with the California Secretary of State who a California resident has authorized to act on their behalf.

We will not require a California resident to set up an account in order to make a request or receive the requested information. In order to respond to a request, however, we must be able to reasonably verify, understand and fulfill the request. We will not be able to respond to the request if we are unable to verify the identity or the authority to make the request. In conducting verification, we generally will use Personal Information previously collected by us. If the request is made on behalf of another individual, we may require additional verification and documentation of the individual’s authority to make the request. In responding to requests, we may limit the information provided for privacy and security reasons, as permitted by law.

We will not charge a fee to respond to a request unless it is excessive, repetitive or unfounded. If a fee will apply, we will advise the requester before completing the request, explain why a fee applies, and provide an estimate of the fee.

Collection and Use of Personal Information

In providing our services, we collect or receive Personal Information from Test-Takers, as well as Test Administrators. Certain Test-taker Personal Information is provided to us by the Test Administrator, and other information is provided to us by the Test-taker. Test Administrator Personal Information is provided to us by the Client and the Test Administrator. We use this information in order to administer and score the tests and provide test results to the Client. We will handle and treat all Personal Information collected and received by us in connection with our service in the manner outlined in this Privacy Policy.

  • Test Administrator Personal Information Collected. The Personal Information that we collect, receive, or process with respect to a Test Administrator may include: name, phone, email address, street address (including city, state or province, country and postal code), company/organization, job title, primary job function, educational background (including degrees, majors, institution, years attended and year of graduation), professional experience using testing assessments.

     

  • Test-taker Personal Information Collected. The Personal Information that we collect, receive or process with respect to a Test-taker may include first name, last name, email address, login ID, alternate ID, postal code, current or most recent job title, current or most recent position type, current or most recent industry, current or most recent occupation, sex, race/ethnicity, age, reason for taking the test, native language. In the computer-based testing process, we collect and score the test-taker’s responses to test questions and produce raw scores and test scaled or percentile scores.


The Client or Collaborator is responsible to obtain all legally required consents from Test-takers for the collection and processing of data by us in connection with
our services. We reserve the right to do the following:

  • Aggregation of Non-identifiable Data. We may statistically aggregate in non-identifiable form test responses and other information collected in the testing process for research, quality control, operations management, security and marketing purposes and to enhance, develop or improve tests, testing processes, and other tools or services. This non-identifiable data may be provided to our Clients, as well as researchers, test developers, and our contractors.

     

  • Transfer of Information. We transfer Test-taker Personal Information to the Client by making it available to Test Administrators through this site. We may also transfer Test Administrator Personal Information to the Client. The Client should be contacted for information about its privacy policies.

     

  • Other Transfer of Information. In addition to transmitting Test-taker Personal Information to the Client, we may disclose personally identifiable information concerning a Test-taker or a Test Administrator in the following situations: (i) in response to a subpoena, court order or legal process, to the extent permitted and required by law, (ii) to protect the security of a Test Administrator or a Test-taker, or the security of other persons, consistent with applicable law, (iii) to address actual or suspected fraud or other illegal activities, (iv) in connection with a sale, joint venture or other transfer of some or all of the assets of Ambition Profile., (v) to our contractors or agents, who are committed or obliged to protect your privacy in a manner consistent with this Privacy Policy.

Data Categories

We may collect and/or disclose to third parties the following categories of data in order to manage our day to day business needs including, but not limited to, providing you with our services, performing services on behalf of a business, payment processing and financial account management, business planning and forecasting, system improvements, security and fraud prevention, and compliance with legal and regulatory obligations:

(A) Identifiers such as a real name, address, unique personal identifiers, or email address
(B) Customer records such as signature
(C) Characteristics of protected classifications under California or federal law
(D) Commercial information, such as products or services purchased, obtained, or considered
(E) Internet or other electronic network activity information such as information regarding a consumer’s interaction with an Internet Web site, application, or advertisement

Protection of Personal Information

We take reasonable precautions and employ reasonable security safeguards to protect Personal Information from loss, misuse and unauthorized access, disclosure, alteration or destruction.

Information from Children

This testing administration system and our talent assessment and human resource testing services are not directed to children or anyone under the age of eighteen (18). Ambition Profile will not knowingly collect, maintain or use any personally identifiable information about anyone under the age of eighteen (18) through this site or the test administration system.

Information Received from Internet Service Providers

This website receives information that is automatically generated by a user’s Internet service provider (ISP). This information may include the IP address (a number automatically assigned to a computer by the ISP), the associated URLs, domain types, the browser type used to access our site, the country, state and telephone area code, the location of the ISP’s servers, the pages of our site that the user views, any search terms entered on this site, and the user’s website address and email address. This information may be collected for system administration purposes, to gather broad demographic information and to monitor the level of activity on the site. Ambition Profile does not link IP addresses to personally identifiable information, however, we reserve the right to link IP addresses and other information supplied by the ISP to personally identifiable information in order to protect the integrity of our system and for security purposes.

Cookies

Cookies are small text files that a website transfers to your computer’s browser. We use cookies to measure traffic patterns, personalize content and control security. The cookies we use supply non-personally identifiable information, but they may identify your computer, browser and Internet specifications.

Web Analytics

Ambition Profile may use third-party web trend analytical services, including Amazon Web Services and FIrebase, to collect visitor information, such as IP addresses, browser types, referring pages, pages visited and time spent on a particular site. While these analytical services collect and report information on an anonymous basis, they may use cookies to gather web trend information. The information gathered may enable Ambition Profile (but not the third party web trend services) to link information with the application and system log data. Ambition Profile uses this information for system administration and to identify problems, improve service, detect unauthorized access and fraudulent activity, prevent and respond to security incidents, appropriately scale computing resources and otherwise support and deliver the Services.

Do Not Track

This site does not currently respond to Do Not Track signals.

Transmission of Information

Data collected and received by us in connection with the delivery of services may be transmitted to The United States and Germany, and is hosted in The United States for clients in the United States, and Germany for clients in the European Union and other countries. The Internet is a global environment. By using this site and sending information to us electronically, you consent to trans border and international transmission of any data that you may choose to supply us. Information transmissions to this site and emails sent to us may not be secure. Given the inherent operation and nature of the Internet, all Internet transmissions are done at the user’s own risk.

This site may contain links to other websites on the Internet that are owned and operated by third parties, or by Ambition Profile or its affiliates. The information practices of those websites are not covered by this Privacy Policy, but by their own terms and policies, which you should read carefully. Ambition Profile has adopted the following Privacy Policy applicable to Personal Information that it may receive concerning people who take tests through this site (“test-takers”) for Talent assessment, Human Resources, or Research purposes.

Talent Assessment and Human Resource Services

We provide testing services as a service provider to employers, prospective employers and human resource placement firms and organizations that have talent assessment and human resource testing programs for employees and prospective employees. These employers, prospective employers and human resource placement firms and organizations are called “Clients” in this Privacy Policy.

Your Rights and Responsibilities

You agree that by visiting and/or providing, transmitting, or having another party you have authorized transmit your Personal Information to us on any of our Sites, you are accepting the practices described in this Privacy Policy and any updates made to this Privacy Policy. It is your responsibility to read this Privacy Policy and check for updates on a regular basis. In performing talent assessment, human resource test services, and research studies, we collect or receive Personal Information concerning employment candidates and employees who take tests at the request of a Clients (“test-takers”). Certain information is provided to us by the Client, and other information is provided to us by the Test-taker. We use this information in order to administer and score the tests and provide test results to the Client, and for research studies for the development of our services. We will handle and treat all Personal Information collected and received by us in connection with talent assessment, human resource testing, and research studies, in the manner outlined in this Privacy Policy.

  • Personal Information Collected. The Personal Information that we collect, receive or process with respect to a test-taker includes: first name, last name, email address, login ID, alternate ID, postal code, current or most recent job title, current or most recent position type, current or most recent industry, current or most recent occupation. In the computer-based testing process, we collect and score the test-taker’s responses to test questions and derive raw scores and test scaled or percentile scores.

At the option of the test-taker, the following additional information may also be collected, received or processed: Reason for taking the assessment, sex, race/ethnicity, age, years in current or most recent occupation, highest level of education completed and country. Providing such additional information is wholly voluntary and optional.
All personally identifiable information that we collect, receive or process with respect to a test-taker is called “Personal Information” in this Privacy Policy.

  • Aggregation of Non-Person-Specific Data. We may statistically aggregate in non-person-specific form test responses and other information collected in the testing process for research, quality control, operations management, security and marketing purposes and to enhance, develop or improve tests and testing processes. This non-identifiable data may be provided to Clients, researchers, test developers and our contractors. By proceeding with a test, you give your consent to this non-person-specific data aggregation and the use and transmission of this aggregated statistical data as outlined above.
  • Transfer of Information. By taking a test through this system, you consent to the collection and processing of your Personal Information by us on behalf of the Client or Collaborator who requested you to take the test, and to the transmission of that information by Ambition Profile to such Client or Collaborator. For further information about how the Client may use your Personal Information, please contact the Client.
  • Other Transfer of Information. In addition to transmitting certain Personal Information about you to the Client, we may disclose Personal Information in the following situations: (a) in response to a subpoena, court order or legal process, to the extent permitted and required by law, (b) to protect your security, or the security of other persons, consistent with applicable law, (c) to address actual or suspected fraud or other illegal activities, (d) in connection with a sale, joint venture or other transfer of some or all of the assets of Ambition Profile AP., (e) to our contractors or agents, who are committed or obliged to protect your Personal Information in a manner consistent with this Privacy Policy. By taking a test through this system, you give your consent for your Personal Information to be transmitted in the situations outlined above.

EU General Data Protection Regulation (GDPR)

In the following, we will inform you about how your personal data are collected when you use our website or service, or take our tests. Personal data means all data that personally relate to you, such as name, address, e-mail address(es), user behavior. Data processing activities related to Ambition Profile and internal processes are documented and regularly reviewed. These records of data processing also assist test administrator in the fulfillment of their data protection obligations outlined in Article 30 of the GDPR.

Controller for data processing

The joint controllers pursuant to Article 4 Paragraph 7 of the EU General Data Protection Regulation (GDPR) are Ambition Profile and Ambition Profiles’ Client.

Your rights

You have the following rights with respect to personal data that relate to you:

General rights

You have a right to information, rectification, erasure, restriction of processing, objection to processing and data transferability. If processing is based on your consent, you have the right to revoke this consent.

Data processing rights based on legitimate interests

Pursuant to Article 21 Paragraph 1 of the GDPR, you have the right to object against the processing of personal data that relate to you that takes place on the basis of Article 6 Paragraph 1 e of the GDPR (data processing in the public interest) or based on Article 6 Paragraph 1 f of the GDPR (data processing for the purposes of legitimate interests); this also applies to profiling supported by this provision. If you object, we will no longer process your personal data unless we can prove compelling grounds for processing that outweigh your interests, rights, and freedoms, or if processing serves to assert, exercise, or defend legal claims.

Rights for direct advertising

If we process your personal data to directly advertise to you, you have the right to object to the processing of the personal data that relates to you for the purposes of such advertising at any time, pursuant to Article 21 Paragraph 2 of the GDPR; this also applies to profiling if it relates to such direct advertising. If you object to processing for the purposes of direct advertising, we will no longer use your personal data for such purposes.

Right to complain to a supervisory authority

You have the right to complain to a responsible data protection supervisory authority about us processing your personal data.

Collecting personal data when you visit our website

When simply using the website for informational purposes, i.e., if you don’t register or send us information in another way, we only collect personal data that your browser sends to our server. If you want to view our website, we collect the following data that are required for technical reasons in order for us to display our website and guarantee its stability and safety. The legal basis for this is Article 6 Paragraph 1 f of the GDPR:

IP address, date and time of request, time zone difference to Greenwich Mean Time (GMT), content of the request (specific page), access status/HTTP status code, respective volume of data transmitted, website that the request has come from, browser, operating system, and the interface, language, and version of browser software. These data cannot be used by us to identify the individual user. This information is only evaluated by us in an anonymized way for statistical purposes.

Contacting us by e-mail 

When you contact us by e-mail, we store data you have shared to respond to your question or issue. This information is used to clearly define your request and to improve how your concern is processed. This information is explicitly provided on a voluntary basis and with your consent; Article 6 Paragraph 1 a of the GDPR. If this information relates to channels of communication (for example, e-mail address, phone number), you are also agreeing that we may contact you via these channels of communication where necessary in order to respond to your concern. You can of course withdraw this consent with future effect at any time. We delete such data when they no longer need to be saved, or we restrict their processing if legal retention periods apply.

Registration and client account

You have the option of registering with us for a client, test administrator or test-taker account. We collect and store the following data about you for registration:

  • Prefix/Title
  • First name
  • Last name
  • E-mail (user name)
  • Password
  • Date of birth
  • “Private” or “Company” account type
  • Street address (Only for Client accounts)
  • Zip/postal code, City (Only for Client accounts)
  • Country (Only for Client accounts)
  • Telephone


We use a “double opt-in process” for registration, i.e., your registration is only confirmed if you have first confirmed your registration by clicking on the link in a confirmation e-mail sent to you. If you do not confirm registration within 24 hours, your registration is automatically deleted from our database. The above-mentioned data is mandatory; however, all other information can be provided on a voluntary basis via our website.

After successful registration, you are given personal, password-protected login details and you can view and manage the data you have saved. Registration is voluntary, but may be required to use our services.

If you use our website, we store data about you that are required to fulfill the Client contract, and information about the payment method, where necessary, until your access expires. We also store data provided by you on a voluntary basis for as long as you use the website, unless you delete this beforehand. You can manage and change all information in the protected client area. The legal basis for this is Article 6 Paragraph 1 a, b and f of the GDPR.

Online orders

If you place an order with us online through our website, we collect various data required to conclude the contract. The legal basis for this is the conclusion and execution of a contract based on Article 6 Paragraph 1 b of the GDPR. Data are stored for the duration of the contract and in accordance with legal obligations. We use a number of payment service providers to process payments, which are always specified and directly accept your input, and are therefore the recipients of your personal data collected in connection with the payment process. The legal basis for using payment service providers is contract processing pursuant to Article 6 Paragraph 1 b of the GDPR. Data for payment purposes are stored for the duration of payment processing.

Personal data of Test-takers

It is the responsibility of the client to obtain consent for the collection and storage of data that could be used to identify a test-taker (e.g. name, date of birth) if that data is going to be collected and used during the testing process. The data is automatically archived in a backup system in order to be able to recover it in the event of a disaster.

Test protection

Please note that test protection is included in data protection and neither the items within a test nor the results should be made public.

Professional testing procedures should be used when administering tests. Tests should be administered under controlled conditions, which includes verification of the identity of the test-taker, supervision of the test procedure (by a trusted representative if the test is being held remotely) and prevention of unauthorized aids and communication.

Data transfer

Your data will not be transferred to third parties unless we are legally obliged to do so, if we are required to transfer data to execute the contractual relationship, or if you have previously given your express consent for your data to be transferred.

External service providers and partner companies, such as online payment providers or shipping companies engaged for deliveries, only receive data if this is required in order to process your order. In these cases, the scope of the data transfer is restricted to the required minimum. If our service providers come into contact with your personal data, we ensure that they comply with the provisions of data protection laws to the same extent that we do, as part of contract processing pursuant to Article 28 of the GDPR. Please also take note of the each provider’s privacy policy. The respective service provider is responsible for the content of third-party services, whereby we review the services for compliance with legal requirements, where this is reasonable.

Data security
